Former Marion County Judge Launches Practice as Mediator at HLGR

Pamela AbernethyAfter completing 18 years of service as a Marion County judge, Pamela Abernethy is launching the next phase of her career as a mediator, arbitrator, and litigator in Salem. Pamela Abernethy recently joined HLGR and is working full-time from the Salem office beginning January 3, 2012. She will be serving clients in Portland, Salem, Eugene, and the mid-Willamette Valley. Ms. Abernethy will serve as a mediator, arbitrator, and reference judge in all areas of law, including: business and tort litigation; transaction disputes, professional liability actions, employment and labor matters, personal injury claims, and family and probate matters. She will also practice as an attorney with an emphasis on government and public law and complex civil litigation. HLGR Welcomes Kate Grado as New Associate

Kate GradoHarrang Long Gary Rudnick P.C. is excited to announce that Kate Grado - who was a summer associate last year - has joined the firm as a full-time associate in our Portland office.

Kate previously clerked for the U.S. Department of Homeland Security and served as a judicial intern to the Honorable Anna J. Brown, U.S. District Court Judge for the District of Oregon.

Kate has a J.D. from Lewis & Clark Law School, where she graduated magna cum laude and served as the submissions editor of the Lewis & Clark Law Review. During law school, Kate worked with the Small Business Legal Clinic and the Lewis & Clark Legal Clinic and served as a mentor through the Women's Law Caucus.

Kate is a two-time recipient of the Lewis & Clark Pro Bono Honors Award and a three-year recipient of the Dean's Scholarship for Excellence. Kate also has a B.S. in Visual Communications from Ohio University, where she graduated cum laude.

HLGR Attorneys Shepherd and Mountain Uphold Confidentiality of Public Records

Pete ShepherdJim MountainThe Public Records Law generally requires public bodies to make documents available to members of the public upon request. A separate Oregon law, ORS 181.854(3), protects from disclosure information gathered in investigations of complaints against law enforcement officers where the investigation does not result in disciplinary action.

The ACLU asked the City of Eugene publicly to disclose the substance of an internal affairs investigation that did not result in discipline of any police officer. HLGR's client, the City of Eugene, denied the ACLU's public records request. After the Lane County District Attorney denied the ACLU's petition to force the City to disclose the records, the ACLU sued the City.

At trial on October 20, 2011, Pete Shepherd, with assistance from Jim Mountain, persuaded the Lane County Circuit Court that the burden was on the ACLU to show in the words of the statute that the "public interest requires" disclosure. The court noted that ORS 181.854(3) serves the public interest by facilitating effective internal affairs investigations of alleged police misconduct. The court then ruled that the ACLU had not met its' burden, thus upholding the City's denial of the ACLU's request.

HLGR Attorneys Help Secure Decision Resulting in Substantial Savings for PERS Employers

Bill GarySharon RudnickBob SteringerJoshua StumpHwa GoOn October 6, 2011, the Oregon Supreme Court issued its decision in Arken v. City of Portland et al and Robinson v. Public Employees Retirement Board, holding that the Public Employees Retirement Board (PERB) is acting lawfully to correct the retirement benefits received by certain PERS retirees who benefitted from the prior Board's unlawful distribution of 1999 PERS Fund earnings. Based on the efforts of HLGR Attorneys Bill Gary, Sharon Rudnick, Bob Steringer, Joshua Stump and Hwa Go, the Oregon Supreme Court ruled that PERB is entitled to end the overpayments going forward and to recover overpayments that have already been made. The court concluded that it would be a breach of PERB's fiduciary duty to permit some PERS retirees to receive and keep overpayments at the expense of other, current PERS members. This decision results in direct and substantial savings to all PERS employers, and enables PERB to save or recoup approximately $800 million — all of which bodes well for the soundness of Oregon's PERS system into the future.

As part of the United Way Day of Caring on September 21, HLGR attorneys and staff spent the day landscaping at Pearl Buck Center in Eugene. Pearl Buck Center helps individuals with developmental disabilities to develop the skills and experience to better realize their potential, enrich their lives, and contribute to society. The center also houses a preschool for children whose parents have special needs. Pearl Buck Preschool is designed to support the parents and foster optimal development in their children (most of whom have the potential for average and above-average intelligence). The six HLGR participants (Craig Capon, Andea Coit, Joanne Austin, Carol Dusine, Tenaya Meaux, and J. Morceaux) were so happy to spend the day doing a little to help such a great organization. Thank you to all at Pearl Buck Center for what you do every day!

HLGR Attorney Successfully Defends Police Officer in Lawsuit

Jens SchmidtAfter a four-day trial, a federal jury rejected the claim that a former Springfield police officer used excessive force. HLGR attorney, Jens Schmidt, successfully argued that Evan Sether (now an Oregon State Trooper) made an appropriate split-second decision when he used a taser to stop a Cottage Grove man who attempted to flee during a traffic stop. On Sunday, September 18, several employees, together with assorted family and friends and more than 30,000 others, participated in the Susan G. Komen Race for the Cure®. Race for the Cure® is the annual fundraiser event in Portland and Eugene that supports local breast health education and breast cancer screening and treatment programs in addition to supporting national breast cancer research. "Doing the Most Good" Award Goes to Riherd

John RiherdOn September 22, HLGR attorney, John Riherd will be presented with the "Doing the Most Good" award from the Portland Metro Board of The Salvation Army (TSA). The award will be presented at the All About Kids banquet in Portland. The name of the award has its genesis in a 1919 quote from Evangeline Booth, daughter of The Salvation Army founder, William Booth. In the forward to her book, published immediately after World War I, she wrote, "There is no reward equal to that of doing the most good to the people in the most need."

Each year the award goes to an individual or group who: goes above the expectation of their role; looks at representing the good of TSA outside themselves; consistently supports the mission of TSA; uses their role on the Board/Committee/Council outside their obligation (as a voice of TSA when not in a meeting, etc); and whose results of their efforts go to people TSA is trying to touch.

Upon hearing of the award, John said, "I have had the pleasure of serving on the advisory board for The Salvation Army both in Spokane and here in Portland for about 30 years. And, I have always been impressed with the amount of good that the Army does in our communities. So, as simply one individual who tries to make a difference, I feel very humble in receiving this award."

HLGR Helps Tribes Secure New Law Enforcement Powers

Aided by a team led by Jim Green and Pete Shepherd from Harrang Long Gary Rudnick, the police departments of federally-recognized Indian tribes in Oregon secured the power to contribute to public safety on equal terms with other professional law enforcement organizations. The victory capped years of effort and didn’t come until the waning days of the recently-adjourned Legislative Session.

The Confederated Tribes of the Coos, Lower Umpqua, and Siuslaw Indians – a client of Harrang Long Gary Rudnick – celebrated the event by hosting the signing ceremony by which the bill became law. The Governor, Secretary of State, State Treasurer, and Co-Speaker of the House of Representatives joined with other officials for the event. The event appears to have been the first time in Oregon history in which a Governor signed a bill into law while in Indian Country. Click here for an account of the event.

The bill, authorizes tribal officers to take law enforcement action under state law. Before that authority can be claimed, tribal governments and their police officers must meet the same rigorous training and regulations that apply to state and local law enforcement officers. HLGR's Efforts Result in Client's Exoneration

Bill GaryDave FrohnmayerAs The Oregonian and other media reported recently, HLGR attorneys, Bill Gary and Dave Frohnmayer, successfully worked to exonerate their client, Mark Long, in a dramatic turn of events that has received ongoing media coverage. Mark Long, interim director of the state's Energy Department, and three other state workers were threatened with criminal charges and possible jail time by state criminal investigators in relation to the award of a state contract. As a result of HLGR's efforts, the four Energy Department workers, including Mark Long, were exonerated. Additionally, the Attorney General asked the Chief Counsel for the Criminal Justice Division of the Oregon Department of Justice to resign as a result of wrongdoing related to the investigation. "I think it's a good thing for the state of Oregon," Sharon Rudnick--HLGR partner and one of Mark Long's attorneys--was quoted as saying of the outcome.

HLGR Wins Victory on Behalf of City of Eugene in EmX Matter

As reported in the Register Guard, Judge Rasmussen of the Lane County Circuit Court granted a motion filed by HLGR shareholder Bob Steringer on behalf of the City of Eugene to dismiss a declaratory judgment action asserting that the Eugene City Charter requires a city-wide vote before the City agrees to approve construction of bus rapid transit service in West Eugene. HLGR's Appellate Team Wins Reversal for Clackamas County

Susan MarmadukeJona MaukonenOn June 15, 2011, the Oregon Court of Appeals reversed the trial court and agreed with HLGR's appellate team (Susan Marmaduke, Bob Steringer, and Jona Maukonen) that Clackamas County was not required to continue providing the same level of retiree health care benefits after the fund established to pay for the benefits was exhausted.

The Court of Appeals agreed that the County's contract with its former Sheriff's Office command staff required it to provide the benefits only so long as the fund had enough money to pay for them, and did not require the County to tap other funds for that purpose. Jim Green Elected as Salem-Keizer School District Director, Zone 4

Jim GreenJim Green -- of counsel attorney with HLGR -- was recently elected to a four-year term as the Salem-Keizer School District Director, Zone 4 (south Salem). As reported by the Statesman Journal, Jim was eating dinner with his family when he heard the news of his win.

The response from his family? His children broke out in song, regaling him with a rousing rendition of "You are my sunshine."

Jim has been involved with the school district for years. He is currently serving as the chair of the Salem-Keizer School District budget committee.

In his new role, Jim wants to focus on student achievement, including eliminating the achievement gap and improving the graduation rate.

"I'm happy," he said, "now it's time to get to work."

Arden Olson to be on Panel Discussion About Protection of Confidential Client Information

Arden OlsonHLGR Shareholder Arden Olson will be one of the faculty members for an upcoming ALI-ABA Seminar entitled “Confidential Client Information: When Are Secrets Not Secret?” which will be broadcast live as a telephone seminar and audio webcast on Thursday, April 14, 2011 at 9:00 a.m. PDT. Arden is a current member of the ABA’s Standing Committee on Professionalism, and he just completed a term as a member of the ABA’s Standing Committee on Ethics and Professional Responsibility.

This seminar is part of the ALI-ABA’s ongoing Ethics and Professionalism series. In it, Arden and other participants will explore the scope of confidential client information that is protected under the Rules of Professional Conduct – a category of protected information that is much broader than that which is protected by the attorney-client privilege. The seminar will focus on:

  • How different states approach that which the Rules require be kept confidential.
  • When a lawyer may reveal information in a dispute with her client.
  • When communications to subsequent counsel for a client are not permitted.
  • How lawyers can get in trouble for threatening disclosure of confidential information.
  • How legal assistants can get lawyers in trouble for unauthorized disclosures.

Pete Shepherd Retained to Defend PERS Against Efforts to Disclose PERS Participants' Pension Payments

HLGR’s Pete Shepherd was hired by the state’s Public Employee Retirement Board after the Board was ordered by the state Attorney General to divulge actual pension payments made to retirees in response to public records requests made by state newspapers.
